Got rear ended.. want my money
Hi guys, i have another question
so about a month ago I was at warden and steeles, standing at a light for abt 3 seconds, when suddenly a van rear ended my car. I got out and got his info, including his drivers license, his registration and his insurance info, also I wrote a statement regarding what happened and that he was 100% at fault and had him sign it. We agreed not to goto the police about it, but i did anyway and filed a report
The damage itself looks very minor, a bit of scratches, didnt look like the rise body got hit, so today i got a quote and the estimate was $510 for the repairs, might be extra cus they need to inspect the bumper on the inside and see if theres anything wrong.
Ive never been in an accident before, and im not sure how it works, but how do i go about making him pay up? I plan to call him sometime this week about the quote, but i dunno if hes willing to pay that much, in which case should i take him to court? i have no idea how to deal with this stuff, and i dont want my insurance to go up, cus i know some places even if u report an accident u rates go up regardless whether or not u were at fault.
What should i do?

understand this, if someone rear ends you, you basically have their balls in your hand. you call the shots. what you should have done was go and get an estimate and serve him up the bill. Unfortunately you went to the reporting center and filed. Which means you are more or less turning things over to your insurance company, which in turn will contact his insurance company. and at the end of the day will sooner or later fix your car.
Your conversation with the other guy will not be so friendly once he finds out you broke the agreement and filed a report. He doesnt have to pay you anything now because its out of your hands, your insurance company will take care of it. His insurance can and almost certainly will go up, yours will remain the same because you are not at fault.
Unfortunately, had you gone directly to him you could have named your price. and he is willing to pay a premium to pay your damages and keep it off the record. you could have repaired your bumper and afford enough to buy a lip or something

are you sure they did not send the info to insurance? I think by law if an accident is reported to the police they are required to file it down and notify insurance. I would really check up on it if I were you, don't just take their word for it.

@ron
well they asked me when i reported the collision if i wanted them to do the filing for me by contacting the insurance company themselves, i said no, so they gave me a handout saying well this is what you should fill out if you do plan to claim it, a week later, i got another call from the collision centre asking me if i wanted them to file it, bc after 1 week they will not file the claim (i think its cus thats how insurance works? u have 1 week to file or something right?)

thats correct, most of the reporting centers i have seen are actually run / owned by the insurance companies. As an alliance. once a report is created, I am pretty sure it gets CC'd to all parties. Its because they want to know if you have insurance or not.
If you take money from that guy, and he gets nailed... your going to have someone not happy. its not worth it

once u report it at collision centre, it'll automatically go through insurance and nothing much u can do now. just let insurnace deal with it, youll get your car fixeed in no time and while it's being fixed you;ll get a rental car works out fine at the end.
some idiot rear ended me in my moms accord recently and that's all they did it.
except i drove it to honda dealership right after (kennedy and ellsmere) and left it there while insurance did everything and honda gave me rental car right away. insurance didnt like it but car was brand new.. and my mom wanted it to go through dealership hehehe
car is good as new now

this is completely out of topic.. but still insurance related.
A few days ago (the day when it was 15degrees out) on Yonge and Finch I saw a G35 rear end a really old-school classic 911 Turbo. In this case, can the owner ask for more than the cost of repairs? I say this because consider the value of the man's 911 Turbo; a lot I would assume. Because the jackass G35 rear ended him, the car will now have an accident title I would assume, and even if not, will have a non-original bumper (i.e. it is now replaced). This will ultimately drive down the resale price of the 911.
How can the 911 turbo owner be compensated by this? Will he be compensated?
I felt so sorry for the Porsche owner, his car was such a mint classic and the douchey guy hit him

your sympathy would change if it was you that accidentally hit the guy hehe. lol well thats why its up to you.
Remember my bumper when i got hit by that 17 year old kid. I told him 2300 or insurance. Did i take more then what was worth? yeah, but not really
The paint wasnt even dry on that kit yet and someone already hit it. it was 10 hours of labor to get that thing on. And my bodyshop more or less refused to do the same kit over again. which left me in a bad position. 2300 was fair.

From my experience when the woman backed into my car. I took it to the reporting centre and before I started giving my info or anything the guy asked me "are you going through insurance?" I replied "No, she said she will pay" he told me that "well in that case have yourself a great night" and sent me on my way. As soon as they start the report its all recorded through the insurance borough. Good luck
