thats exactly why im not too sure if Im going to take action or not, but I am confident that I would win IF the dyno was in fact NOT calibrated right....

I'm not jumping on the RRM bandwagon saying xtremeboost's kit is bad, its just RRM offers a more reliable (what i can tell from the land of the internets) tune with their package which is worth the extra $$$ so you don't end up with a blown engine.
Also don't take my quote out of context, i am saying that my car (09) is newer and therefor has not had very many turbo builds on them. Therefor not a whole bunch of places have good, reliable tunes for the 2009 motor with a turbo kit on it.

if you signed a waiver you will NOT win. Thats the point of a waiver. Completely abolishes them of all wrongdoing if your car screws up.
Might as well just forget about it and start figuring out what you're going to do next.....
and the thing about the RRM kit that you keep forgetting to realize, is that its PRE TUNED. You dont need to go out and spend another couple hundred on a professional tune. Would it help? Sure, a professional custom tune helps any car, but its not required with their kit. Xtremeboost doesnt even have a "kit" so you cant really back up something that isnt really out there being produced. Whether the engine damage was your fault, xtremeboost, or the shop's, for those looking for a kit that is already known to work right after install, RRM is the ONLY option. Xtremeboost's "turbo kit" is nothing different than anyone on this board getting their own parts, building it themselves, and going and getting it tuned by someone else

also EVEN IF you somehow argued that their machine was wrong and the waiver becomes invalid, you've already posted on the forums how you turned up the boost past what you were tuned for, so right there "legally" the fault lies on you for blowing the motor. The shop can just say they tuned you for a certain boost level, which you exceeded, and thats why you blew your motor, not their tune. It may be technically wrong, but its the same way the dealerships get people for voiding their warranty.

It's not that simple, they can easily say "modifying cars is a risky business, the customer chose to push the car to its limits and it failed". You freely admit to turning up the boost despite not knowing if it's safe to do so. Unless you can prove that the tune was wrong, you're SOL. Even if the dyno was off, if they tuned in any level of safety, they can claim it wasn't their fault. Since you have no datalogs, you have no evidence supporting your claims.

dude, i signed a waiver, yes, but the waiver does not say "even if our machine is setup wrong and gives the wrong information, it is still your fault...." that would be rediculous, and that could be easily fought in court. dyno waivers pretty much say "you can use our CORRECTLY CALIBRATED machine, but if it blows up because you pushed it, its not our fault" And again, xtremeboosts kit is reliable, just dont turn up the boost to 9!

LMAO!!!! when did i ever say I turned up the boost AFTER the tune?? the car was at 9 lbs, and was TUNED for 9 lbs.......i turned up the boost, WHILE getting tuned, and got tuned FOR IT. and the "shop" didnt tune my car, Jestr did...do you know how these things work? you setup an appointment with a shop to use the dyno (in this case, a dyno day) and call the tuner to come to whatever shop it is (in this case Jestr) and the tuner tunes your car, using the shops dyno........wow people, honestly...
and according to the dynos AFR readings, it WAS safe, but the computer could have been miscalibrated and have been giving a wrong reading all along, which would mean its the shops fault for not having a correctly calibrated machine.
if you go to a tire shop and have new tires put on, and they use a torque wrench set at 10 ft lbs of torque on your lug nuts, and your lug nuts and wheels fall off while driving, even if the shop did the work correctly, is it your fault?

Ok now i'm lost. Who tuned this, who turned the boost up to 9, who installed the kit.
So if i'm following you correctly......Xtremeboost supplied you with their prototype "Kit" to use your car as a test bed....you brought the car to get tuned at this particular dyno.....you upped the boost to 9lbs and wanted it tuned there? Who's idea was it to do 9lbs? yours, the tuners, or xtremeboost. Was xtremeboost present during all of this? Cuz i dunno, 9lbs is pretty risky, so if it was xtremeboost's idea to tune this thing at 9lbs, thats a little irresponsible in my opinion. If it was your idea, well then its your fault and your ego got a hold of you. 9lbs on a good tune is still pushing it with the specs of this engine. if your compression ratio was a tad lower maybe it would have been ok.

alright...
this kit in a way was not a "prototype," because they had a kit running before mine, but due to private circumstances within their shop, they had to make a new, second kit which was for my car.
i brought the car to get tuned at this particular dyno
i upped the boost to 9 and had it tuned there
it was the tuner and I's idea, because he said it felt strong on the dyno and was running very good, better than he expected, with no signs of detonation, knocking, etc. and i trust his judgement because hes tuned Evos all over the nation for many many years, and knows how to tune!
xtremeboost was not present at the time of the tune
9lbs IS risky, I know, but like i said, Jestr said the car was running a lot better than he thought, and so we turned it up to 9 slowly with the MBC, and thats where the boost stabilized at, after the wastegate opened. I agreed because i trust his judgement.
like i said before, there is nowhere on the internet, at least to my knowledge, or anyones on the board, that says what the limitations of this motor are. who knows, maybe i would have turned it up to 10 lbs, and on a good dyno and tune, have made 300 whp and everything would be fine?? but now I, and everybody else, know that this motor can not handle 9 lbs.
dont think I have a big ego, i was listening to my tuners word, but i realize that still doesnt mean hes at fault, because i was the one that actually physically turned up the boost.......
I know about the lower CR, and was planning on doing pistons, rod, crank eventually, but i cant anymore haha
