I am outraged the dealer sold me the car without having checked the plugs...I hope my TC doesn't decide to bite the dust anytime soon.

I honestly would take it back to the dealer and get your money back. Save yourself the aggrevation and future headaches. If your differentials were running dry your looking at replacing the transfer case in the front and the gears in the rear diff.
Get your money back ASAP and just keep your eyes out there for a better evo.

Do whatever you can to make them fix all the broken parts. Your tcase is most likely toast because when you fill it you have to fill it slowly. It seems like it's full and will spit fluid back out but it's not it takes patience to fill. Good luck.

I noticed this, any reccomendations on the way to go about filling it? Is there a fill plug on the bottom of the car that would put fluid directly in the TC? I have been filling the ATF resovoir under the hood and it keeps putting back fluid (over the max line) when the car if off. I have been forced to drive the car to work so I have been babying it.

Aside from the recent noise which is more then likely related to the drain plug being loose, car is fine. Had my tuner check the ECU for tampering, transmission feels good, and the condition of the car looks well taken care of. It's a single owner with reasonable mileage...I simply just don't see a reason to take it back if I can get the problem resolved with little or no cash from me. This is neglect on the part of the dealer, not abuse from the previous owner.

So I called the dealer I bought the car from and explained the situation. He wanted to assure me that the car did not have any problems prior to being sold to me and concurred it was most likely because of the drain plug. He could not confirm that it was one of his techs that touched the plug.
Regardless of who did what he said he could assure me the problem would get resolved. He is tight with the mitsubishi techs at the local dealership near him and assured me whatever it was, it would be fixed under waranty. He agreed the problem was most likely a diff and/or TC, thus he is aware one or both might need to be replaced.
The only problem I have is that my daily driver is going to be laid up while the problem is resolved. I guess we will see if this dealer will come through or if it is just BS. I tend to believe he is a man of his word for everything he has done up to this point. I'll keep you guys posted, and pray this doesn't turn into another stealership horror story.
I am scheduled to bring the car to the sales guy tomorrow. He said he will bring the car to Mitsubishi personally.

Dropped the car off yesterday. The dealer assured me the problem would be resolved. Told me he called the dealer in advance, and said I can expect the car in about 5 days. I'll keep you posted.

You have an MR so I'd have the ayc pump and resivour checked as well. But I guess the mitsu dealership will inspect all that, but it wouldn't hurt to ask if they went over it when you get it back. If it's low, it's always easier for the dealership to burp the AYC then manually doing it with all 4's in the air.

Called Mitsu and they confirmed it was definately the transfer case. They are going to replace it under warranty. When I asked what was the cause of the failure was they said it just went bad. I was under the impression they didn't want to give me a straight answer over the phone for obvious reasons. They also said I had a small leak in the rear tranny seal, so they ordered a fresh one.
They said the parts should arrive Monday and I will have my car back Monday afternoon or Tuesday the latest. I'll keep you guys informed.

Seems that the stock t.case doesn't hold up real well. My first t.case went out will less than 20,000 miles on the car. The ring and pinion gears were both cracking. Mitsu replace the first one under warranty. When it happened the second time with only 10K miles on the new t.case I stepped up and contacted John Sheppard of www.sheptrans.com (also check out www.shepracing.com) I explained to Mr. John the issues I was hearing along with what my overall intent for the car was and he suggested that I send in the tranny and the t.case to be looked at and overhauled. After he received the drive-train he called me up to tell me of the problems that were developing in both tranny and t.case and he went through all the changes/upgrades he could/would do to provide me with the best product built to the level that I wanted/needed for the power level and racing style i intended to use the car for. He did an amazing job and has stood behind his work since I had this done 4yrs and 30,000+ miles ago. Still running strong and holding up without issue!! Highly suggest everyone at least look at his sight even if you aren't in the market for upgrades. Also he is a HUGH supporter of those in the US Armed Forces. In a nutshell, John Sheppard is for Mitsu drive-trains as David Buschur is for Evo motors.

sheptrans came highly recommended by several friends and enthusiasts. they suggested i check him out, even if i wasn't fully set on overhauling the tranny or tc. Thanks for the suggestion, i will absolutely look into them for reinforcing some of the known weak spots in the evos drivetrain. I'm eager to give the car a look over after I get it back from Mitsu as well.

Called Mitsu again today expecting the car to be done. They told me their system went down and the order for the TC failed to go through (Thanks for telling me now...) so the deadline for pickup has been moved back to Saturday or Monday the latest. I understand hiccups and delays but come on now...mitsu customer service sucks.

Get a call yesterday from Mitsu. They apologized to me stating that the car would further be delayed. They said Mitsu corporate wants to send a tech to inspect the Tcase, most likely because I am close to the warranty expiration. Obviously Mitsu is looking for an excuse not to pay out. They said the tech will most likely arrive Tuesday or Wednesay thus my car will be done anywhere between Wednesday and Thursday.
I am offended at the way Mitsubishi is treating me. I can't believe the nerve they have to delay the car further after various screw ups on their end. This is the kind of service that may prevent me from buying a Mitsubishi in the feature. When I had my WRX, every dealership I went to had my car back to me ON TIME for either maintenance or warranty repairs. This is not to say that their customer service was good, because it wasn't, but this is totally unacceptable.

***FINAL UPDATE***
I finally picked up the car last friday. Mitsubishi fully replaced the transfer case under warranty. I checked it out, and the work was fine. I've been driving the car for three days now and no more whine. Everything seems fixed.
